TERMS OF SERVICE
These terms and conditions, as may be amended from time to time, apply to all our services directly or indirectly and made available online, through any mobile device, by email, or by telephone. By accessing, browsing, and using our (mobile) website or any of our applications through whatever platform and/or by completing a reservation, you acknowledge and agree to have read, understood, and agreed to the terms and conditions set out below (including the privacy statement). These pages, the content, and infrastructure of these pages and the online reservation service (including the facilitation of payment service) provided by us on these pages and through the website are owned, operated, and provided by Penny’s Motel & Apres and are subject to the terms and conditions set out below.
BOOKINGS
All bookings at Penny’s Motel & Apres are subject to these terms. We shall also have the right to require full payment in advance or a deposit at the time of booking in certain circumstances or if the booking includes the supply of certain items or services. No booking shall be treated as confirmed until the details and/or payment/deposit described in this paragraph have been provided.
CHARGES
The prices displayed on the websites are an average per night based on two-night length of stay or longer until a specified rate is selected. Any add-ons, services or HST (at the prevailing rate) are included only if specified. A minimum length of stay, deposit, cancellation charge and other conditions may apply to certain rates, as specified. Once a rate is selected on the websites, the total for your requested stay shall be displayed on the reservation summary. Prices shall be charged in the local currency of Penny’s Motel & Apres and any currency conversion facility, if provided, is an approximation tool only. The HST breakdown shown is indicative based on the current rate of HST, and the expected HST treatment of the goods or services. HST will be payable at the prevailing rate applicable at the tax point of the invoice or booking confirmation issued and may change depending on the actual rate and the HST treatment of the goods and services purchased at that date. Price lists, if any, for additional items, such as specialty bookings, events or tour services, are available on request.
CHECK-IN/ CHECK-OUT REQUIREMENTS
In the interests of security and to prevent fraud, at the time of check-in, guests may be required to confirm their identity by providing their booking reference; their passport/identity card/drivers license and a valid credit card. The information above may be requested for each member of your party over the age of 16 and we reserve the right to refuse entry to persons who cannot provide the information set out above. Unless otherwise stated on the booking confirmation guests may check-in at any time from 4:00 p.m. on the scheduled day of arrival. All rooms that have been secured by credit card or prepaid at the time of booking will be held until 11:59pm on the scheduled day of arrival unless otherwise agreed directly with Penny’s Motel & Apres. On the day of departure, we kindly ask all guests to vacate their rooms by 11:00 am (unless a later departure is stated as part of your booking). Late check-out after this time can be requested subject to availability and will be charged at the discretion of Penny’s Motel & Apres. Rooms are subject to maximum occupancy rules set by Penny’s Motel & Apres. If you would like further details, please contact Penny’s Motel & Apres.
PAYMENT
We accept the following methods of payment: credit cards: American Express, MasterCard, Visa. For advance purchase rates the card you booked with may be required to be presented on arrival, along with an appropriate ID. At the time of reservation we will charge the equivalent of your first night’s accommodation rate + HST. At that time you will also be charged for any confirmed add-on services or tickets on the reservation. Seven days prior to your reservation arrival date, we will charge the remaining balance of your accommodation/outstanding services to your credit card on file.
CHANGES OR CANCELLATION BY GUEST
Penny’s Motel & Apres has a 7 Day No Questions Asked Modification/Cancellation Policy. Changes or modifications made before 3pm, 7 days prior to arrival are allowed without penalty. Reservations that have date modifications may be subject to increased rates depending on new booking dates. The full amount of your reservation, the balance of accommodation plus any outstanding services/add-ons and HST, will be charged 7 days prior to your arrival date (or at the time of booking for reservations made within the 7 day period). The reservation becomes non-refundable, non-transferable and non-modifiable within this period (7 days prior to the arrival date). *Group bookings may be subject to different timelines and cancellation periods.
CHANGES OR CANCELLATION BY PENNY’S MOTEL & APRES
Very occasionally we may need to cancel your booking. In such circumstances you will be given a full refund, but we shall have no further liability to you arising out of such cancellation, If your booking is for a specific room and in the same room for the duration of your stay through a "choose your own room" on the website, we will use our reasonable efforts to honor your room selection. However, we may need to allocate an alternative room to you for operational or safety reasons. If we need to move you to a different room during your booking for which a lower rate is available than the rate you booked at, we will refund you the difference in the rates.
DAMAGE
We reserve the right and you hereby authorize us to charge your credit card for any damage incurred to your room or Penny’s Motel or Apres Snack Bar and surrounding property during your stay (including without limitation specialist cleaning charges) or for any items that are missing when you leave.
PARKING
Penny’s Motel & Apres has on site parking for guests. Cars and their contents are left at the owner's/Guest's own risk. We do not accept responsibility for loss or damage however caused (save as may not be excluded or restricted by applicable law).
SECURITY
To ensure a safe environment for all, Penny’s Motel & Apres uses a 24hr surveillance system for public areas of the Motel and Snack Bar area including but not limited to the parking lot, courtyard & motel common areas, as well as exterior and interior of Apres Snack Bar.
GUEST BEHAVIOR
Guests are requested to conduct themselves appropriately at all times and to comply with Penny’s Motel & Apres procedures and/or requests with regard to conduct and respect for the property of Penny’s Motel & Apres, its employees and guests and their health and safety. Guests are requested not to disrupt the comfort and enjoyment of other guests, the operating of Penny’s Motel & Apres, or cause offence to other guests or our members of staff. We reserve the right to refuse accommodation or services or remove you and members of your party from Penny’s Motel & Apres if, in our reasonable opinion, we consider this provision to have been breached. Where this is the case Penny’s Motel & Apres shall have no obligation to refund you for lost accommodation, other services or any other loss or expense incurred.
NO SMOKING
Guests are not permitted to smoke, including vaping or any other substance, in rooms or anywhere on the premises. Penny’s Motel & Apres reserves the right to charge a $1000 cleaning fee if it is determined that there has been smoking/vaping in the room.
CHILDREN
All children (a person under 18 years of age) must be accompanied by an adult and must be supervised by an adult at all times.
PETS, EMOTIONAL SUPPORT & SERVICE ANIMALS
Penny’s Motel & Apres welcomes well-behaved dogs in rooms and on the grounds for a charge of $35/night fee. Penny’s Motel & Apres reserves the right to enforce the following rules:
One Dog per unit
No dog is to be left unattended in the rooms unless on site approval has been granted by staff (*this will be done at the discretion of the staff member based on the dog’s travelling history and demeanour) - Guest must leave a viable emergency contact. Should Penny’s Motel & Apres determine that the dog is in distress, the guest agrees to return to the property as promptly as possible.
No dog shall be permitted on the beds or furniture
All dogs shall be leashed at all times while on property
Owners shall ‘clean up’ after their dog while in the room or on property - baggies not provided on site
Service animals are welcome in all parts of our facilities that are open to the public. Service animal documentation is required for service animals. Any and all damages incurred to the room or property will be charged to the guest accordingly. The guest acknowledges that the $35/night pet fee amount will not limit the right of the Penny’s Motel & Apres to exercise or pursue any remedy available in law or in equity for breach of this agreement, including, but not limited to, damages on appliances or finishes, furniture, or any other costs or losses resulting from the negligence of the guest and their pets.
NO DISCRIMINATION
It is the policy of Penny’s Motel & Apres not to discriminate on the grounds of sex, race, colour, religion, ancestry, national origin, disability, medical condition, genetic information, marital status, or sexual orientation. We believe that we have a duty to our guests to protect them from inappropriate behaviour. Guests are expected to adhere to this policy and Penny’s Motel & Apres may, without incurring any liability to the Guest, immediately remove from the property any person(s) offending against this policy. Should any actions by a Guest be deemed inappropriate by Penny’s Motel & Apres, or if any inappropriate behaviour is brought to the attention of Penny’s Motel & Apres, we reserve the right, after any allegations have been investigated, to take action against the Guest.
FORCE MAJEURE
Penny’s Motel & Apres accepts no liability and will not pay any compensation where the performance of its obligations is prevented or affected directly or indirectly by or as a result of force majeure or any circumstances beyond its reasonable control including, but not limited to, flood, earthquake, extreme adverse weather conditions, natural disasters, other acts of God, acts of terrorism, fire or failure of electric power, gas, water, or other utility service, plant machinery, computers, vehicles or any collapse of building structures.
LIMITATION OF LIABILITY
Penny’s Motel & Apres will not be responsible for the loss or damage of any property left at Penny’s Motel & Apres. Penny’s Motel & Apres will not be liable for any indirect, consequential or pure economic loss or any loss of profit, goodwill or opportunity (whether caused by the negligence of Penny’s Motel & Apres, its employees, contractor or agents or otherwise). Penny’s Motel & Apres’ total liability shall not exceed the value of the charges received by it under the Agreement. Nothing contained in the Agreement or in any other document referred to or incorporated in it shall be read or construed as excluding any liability for death or personal injury caused by Penny’s Motel & Apres’ negligence or liability for fraud or fraudulent misrepresentation.
GOVERNING LAW AND JURISDICTION
This Agreement and any non-contractual obligations arising in connection with it are governed by the province of Ontario and have exclusive jurisdiction to determine any dispute arising in connection with the Agreement, including disputes relating to any non- contractual obligations. Each party irrevocably waives any objection which it may now or later have to proceedings being brought in the Ontario courts (on the grounds that the Ontario courts are not a convenient forum or otherwise).

Cancellation Policy:
We understand that in these uncertain times it's hard to commit. We have a No Questions Asked 7-day* Booking Policy. Changes or modifications before 3 pm, 7 days prior to arrival are allowed without penalty. The full amount of your stay, Room + Tax, will be charged at 7 days prior to your arrival date ( or at the time of booking for reservations within 7 days ) and is non-refundable. This cancellation policy is also in effect for changing dates or total number of nights within a confirmed reservation.
